Trump vows to end birthright citizenship

Ever since his fiery and controversial presidential campaign, Donald Trump has made his stance on immigration perfectly clear: He is almost always against it. He has enforced numerous raids by Immigration and Customs Enforcement (ICE), tried to end Deferred Action for Childhood Arrivals and even forcibly removed immigrant children from their parents.

Now, Trump is preparing for another dramatic move against immigration. He announced that he plans to use an executive order to end the practice of conferring citizenship upon infants born in the United States.

Going against the U.S. Constitution

On October 30th, President Trump gave a speech in which he state that he would issue an executive order to revoke the right of citizenship to the children of non-citizens. In the past, Trump has denounced the use of executive orders, but plans to use one all the same. His speech, which was riddled with inaccuracies, comes one week before a crucial midterm election.

His plan directly contradicts the U.S. Constitution. One hundred and fifty years ago, Congress amended the U.S. Constitution to read, “All persons born or naturalized in the United States and subject to the jurisdiction thereof, are citizens of the United States.”

Non-citizens have rights

Despite the President’s hard-line approach toward immigration, foreign nationals living in the United States still have rights. The path to citizenship may look different for immigrants and their children in the future. For now, however, any babies born in the U.S. still have the citizenship birthright. If their parents are not American citizens, they have the opportunity to seek naturalization. There are several other options for non-citizens to live permanently in the United States, including employment visas, family visas and asylum status.
