Facts about the right to seek asylum in California

On Behalf of | Dec 12, 2022 | Asylum, Blog |

When someone is fleeing violence, oppression, or other dangerous circumstances in their home country, they have the right to seek asylum in another country. This right is enshrined in international law and is a life-saving protection for those seeking safety.

Eligibility

One of the requirements for someone to qualify for asylum is that they must be able to demonstrate a well-founded fear of persecution due to their race, religion, nationality, political opinion or membership in a particular social group.

Process

The process for applying for asylum in the U.S. begins with filing an application with the United States Citizenship and Immigration Services (USCIS). Applicants must go through a series of interviews and screenings, as well as provide documentation to support their claim. If the USCIS finds that the applicant meets all the requirements for asylum, they will be granted asylum status. It’s also important to note that applicants cannot be granted asylum if they arrived in the U.S. without authorization or with a valid visa.

Benefits

If granted asylum, the applicant can remain in the United States and eventually become a lawful permanent resident. This means they can legally work, receive benefits and enjoy all the rights of a U.S. citizen without fear of deportation. Secondly, they can also petition for their family to join them in the U.S., as long as they meet all the requirements for immigration. Last but not least, those with asylum status can travel outside the U.S., though they must be sure to obtain a re-entry permit before leaving.

Despite the right to seek asylum, it is not always easy for those wishing to exercise this right. The immigration process can be long and arduous, with many hurdles to overcome. Furthermore, immigration laws are constantly being updated and changed, meaning applicants must keep up to date on all changes that may affect them. Additionally, there are often immigration scams to be aware of, as unscrupulous individuals may try to take advantage of those seeking immigration status. That’s why it’s important to be aware of the immigration process and know your rights as an asylum seeker.
