How does DACA impact family reunification?

On Behalf of | May 21, 2025 | Immigration Policies |

If you’re a DACA recipient, you might wonder how the program affects your ability to reunite with family members in the U.S. DACA offers important protections, but does not create a direct path to citizenship or permanent residency.

This means family reunification can be more complicated for you and your loved ones compared to those with permanent resident or citizen status.

What protections does DACA provide?

DACA protects you from deportation and gives you work authorization, which helps you live and work legally in the U.S. However, it does not change your immigration status or grant you lawful permanent resident status. Because of this, you cannot sponsor family members for green cards like a U.S. citizen or permanent resident could. This limitation means you’ll need to explore other options to bring family members into the country.

Can family members apply for visas independently?

Your family members may apply for certain visas on their own, but your DACA status does not provide them with any special advantages. For example, your parents, siblings, or extended family would need to qualify based on their own eligibility under family-based immigration or other visa categories. You cannot petition for them directly through your DACA status.

What if you marry a U.S. citizen or permanent resident?

If you marry a U.S. citizen or lawful permanent resident, you might become eligible to apply for a green card through marriage. This process can sometimes lead to family reunification more quickly. Still, this can be complicated depending on how you entered the country and your current immigration situation. It’s important to know that DACA itself does not grant any immediate family sponsorship rights.

What should you keep in mind?

Maintaining your DACA status helps protect you while you explore legal pathways for family reunification. Family reunification requires separate immigration processes, and DACA is just one part of a broader immigration strategy. Staying informed about changes in immigration laws and options available can help you make the best decisions for yourself and your family.
